Alcohol licensing

Licensing of premises where alcohol is sold is governed by the Licensing (Scotland) Act 2005. In Orkney, this is overseen by the Orkney Islands Area Licensing Board, made up of Orkney Islands Councillors.

Premises licences

A premises licence covers everything that happens at a licensed premises. It must include an operating plan describing these activities, and a floor plan that meets the relevant regulations.

Premises managers must complete mandatory training and hold a personal licence before they can authorise the sale of alcohol.

Applications for a premises licence, provisional premises licence, or a major variation must be submitted at least two months before the relevant Licensing Board meeting. Applications submitted after this may not be processed in time.

Every application for a premises licence must include a Disabled Access and Facilities Statement.

Personal licences

A personal licence lets you authorise the sale of alcohol at a premises. You don't need to be a premises manager to hold one, anyone can apply.

To apply, you must complete the Scottish Certificate for Personal Licence Holders at SCQF Level 6.

Personal licences last for 10 years and can be renewed. Before you renew, you must complete a refresher training course or the full course again.

You must also complete refresher training within 5 years of getting your licence, and within every 5-year period after that. You'll need to submit evidence of this to the Licensing Board, who'll remind you when refresher training and renewal are due.

Changing your name or address

If your name or address changes, you must write to the Licensing Team and include:

  • your personal licence
  • 2 new passport photos
  • evidence of your name change, such as a marriage certificate
  • your new address, including postcode, landline and mobile numbers, and email address
