Right of responsible access

The Land Reform (Scotland) Act 2003 gives people a statutory right of responsible access to most open land and inland waters for recreation, education, crossing land and certain commercial activities. This includes activities such as walking, cycling, horse riding and water sports, provided access is exercised responsibly and in accordance with the Scottish Outdoor Access Code. The Act also explains where access rights do not apply and outlines the responsibilities of those using the outdoors.

The legislation places duties on both access users and landowners. Land managers must respect access rights, take them into account when managing land, and avoid actions that unnecessarily prevent or discourage responsible access. Orkney Islands Council has a key role in upholding access rights, promoting good access management, and helping to resolve issues where access is obstructed.
