Environmental Health / Trading Standards / General Enforcement Policy
Environmental Health and Trading Standards are required to make enforcement decisions in accordance with the enforcement policy to ensure consistency. They are also required to effectively use the range of enforcement tools available to them in order to ensure a proportionate response.
In reviewing the existing enforcement policies the opportunity was taken to form a single general policy incorporating the requirements of both the food, and health and safety services, and using their principles. Other regulatory enforcement activities, such as licensing, were also incorporated into this policy. This document underwent consultation and all comments have been incorporated into the Policy which was approved by Committee in December 2023 and is available from the 'Related Downloads' section of this page.
Enforcement notices
A list of enforcement notices served by the Council’s environmental health team can be downloaded from the related downloads section of this website. This list comprises the Council’s statutory register for the purposes of the Environment and Safety Information Act 1988 and includes all enforcement notices served since December 2021.
This list will be updated when additional notices have been served. If a particular type of notice is not listed then it should be assumed that type of notice has not been served. Please note that in order to achieve a balance between openness of information and the protection of commercial interests in an island community Sections 33 and 38 of the Freedom of Information (Scotland) Act 2002 have been applied where relevant to data within the enforcement notices.
Only the information included on this register will be made public in response to FOISA requests for release of information. Extant (ie current) notices that are part of an ongoing investigation which may result in further enforcement action will not be included until the completion of enforcement action; the only exception being those notices which are required to be included for the purposes of the Environment and Safety Information Act 1988 (referred to as ESIA’88 in the register).
