Council’s Reasons For Proposing To Make Order

Under the Scheme of Delegation to Officers Section 2.9.16, The Director for Infrastructure and Organisational Development resolved in terms of delegated powers to introduce a disabled on-street parking order to cover on-street parking bays at the following locations:

  • 35 Laverock Road, Kirkwall.
  • 12 Strombery, Kirkwall.
  • 16 St Rognvald Street, Kirkwall.
  • 14 Market Green, Dounby.

The reasons for proposing to make the order are given below:

  • The Disabled Persons’ Parking Places (Scotland) Act 2009 came into force on 1 October 2009.
  • The Act places a duty on the Local Authority to promote the proper use of parking places in its area that have been designated or provided for use by disabled persons’ vehicles.
  • The Act requires that the Council identify all on-street advisory disabled persons’ parking places and determine whether it is necessary to introduce a traffic regulation order in respect of those places.
  • In deciding whether or not an on-street parking place is necessary and should be retained by the introduction of a traffic regulation order, the Council must determine whether it provides convenient access to the address of a person who holds a disabled person’s badge.
  • The disabled parking spaces detailed above, are necessary and provide convenient access to the address of a person who holds a disabled person’s badge.
