The most recent Orkney Islands Area Licensing Board Alcohol Licensing Policy Statement was due to remain in effect until 29 November 2016.
The Scottish Government has introduced changes to the duration of existing and new alcohol licensing policies from 30 September 2016. Instead of having effective periods of 3 years, they will have effect between the elections of local government councillors. Licensing boards, once appointed following local government elections, will have a period of 18 months to publish their alcohol licensing policies.
The changes also provide that existing statements of alcohol licensing policy will continue in force until such time as new policy statements are published by the relevant licensing boards in accordance with the amended legislative provisions.
The effect of these amendments is that the Board’s existing Alcohol Licensing Policy Statement will continue in effect until a new policy statement is published by the membership of the Board appointed following local government elections in 2017.
In terms of Sections 9A and 9B of the Licensing (Scotland) Act 2005, each licensing board must publish annual statements about their functions and financial information. Boards may publish combined statements.
